What’s at Stake When Paternity Isn’t Established

Under S.C. Code § 63-17-20(B), when a child is born outside of marriage, sole custody belongs to the natural mother by default. An unmarried father has no legal right to custody, visitation, or involvement in major decisions about the child’s life until paternity is legally established. That means no enforceable right to object if the mother limits access, even if he has been present and contributing financially from day one.

Once paternity is established, the picture changes completely. The father gains standing to petition Charleston County Family Court for custody, visitation, and decision-making rights on equal footing with the mother. The child also gains access to the father’s health insurance, inheritance rights from both parental lines, and eligibility for Social Security, veterans, and other government benefits. Paternity determinations are difficult to undo, which makes the initial decision about how and when to proceed one of the most consequential choices in a family law matter.

Three Ways to Establish Paternity in South Carolina

South Carolina law recognizes three distinct paths to establishing legal paternity. The right approach depends on the circumstances, the level of agreement between the parents, and whether DSS is involved.

Voluntary Paternity Acknowledgement Affidavit

Both parents can sign a Paternity Acknowledgement Affidavit at the hospital at birth or later at a SCDHEC or county health department office. Both signatures must be notarized. One important distinction: signing only the birth certificate does not establish legal paternity in South Carolina. A properly executed acknowledgment can be rescinded within 60 days of signing or before any related administrative or judicial proceeding, whichever comes first. After that window, it can be challenged in court only on grounds of fraud, duress, or material mistake of fact under S.C. Code § 63-17-50.

DSS Administrative Establishment

An unmarried father can apply through the SC Department of Social Services by completing a Non-Custodial Parent Application for Services. DSS then arranges DNA testing. If a man is served with an administrative notice of financial responsibility, he has 30 days to respond in writing to contest paternity. Failing to respond can result in a default finding of paternity and a child support order.

Charleston County Family Court Action

Either parent, the child, or DSS may file a paternity action directly in South Carolina Family Court. Under S.C. Code § 63-17-30, the court may order the natural mother, the putative father, and the child to submit to genetic testing. A DNA result showing a 95% or higher statistical probability of paternity creates a rebuttable presumption, a legal finding that stands unless successfully challenged with contrary evidence.
